Non-Academic Misconduct Panel - Terms of Reference

The Non Academic Misconduct Panel is instituted to deal with overall non-academic misconduct involving actively enrolled students at Curtin Sarawak.  The Panel is convened by the Pro Vice Chancellor, where instances of non-academic misconduct have occurred. The Panel makes recommendations based on investigations within the limitations of Statute 10.  For serious offenses, the Police and / or other relevant agencies will be involved.  For cases where expulsion or such is recommended, the Pro Vice Chancellor shall refer to the Vice Chancellor and / or the Board of Discipline at Bentley Campus.

Definitions:
Non-Academic Misconduct
Any misconduct not pertaining to academic matters

Non-Academic Misconduct Panel
Panel convened by the Pro Vice Chancellor for duration of 2 years comprising of academic and non academic staff

Student
Any person enrolled at Curtin Sarawak

Statute 10
Of the Student Disciplinary Statute (Effective 9 December 2005) including any amendments thereafter

Level of offences

Level I                          

Low level offences to be dealt with directly by the Office of Staff and Student Affairs who may issue warning(s) and record of such offence(s) shall be kept in student’s file
Example of offences: parking, smoking and/or consuming alcohol in restricted areas, gambling, nuisance such as causing disturbances through loud noises, trespassing, vandalism etc)

Level II                         

Confirmed offences not of Level I or Level III.  Alleged offenders will be dealt with through the Non Academic Panel, where expulsion is recommended, shall be referred to the Board of Discipline
Example: harassment, assault

Note:    The Director of Staff and Student Affairs upon consultation with the PVC and/or Deputy Vice Chancellor, shall have the absolute discretion in determining the level of offence committed on a case to case basis

Level III                        

Offences punishable under any statutory law of Malaysia shall be referred directly to the Police / Immigration and/or any relevant authority. Offender shall face immediate expulsion from the University
Example: blackmail, extortion, abuse and/or possession of drugs, firearms, theft, etc

Tasks

1.1 Attend to allegations and/or complaints regarding non-academic misconduct instances

1.2 Investigate allegations of non-academic misconduct

1.3 Implement non-academic misconduct policy and procedures in accordance to Curtin’s Misconduct policy and procedures

1.4 Communicate with relevant department(s) / person(s) regarding policy directly related to allegations / investigations

1.5 Monitor the security and well being of students

1.6 Provide the Management with information relevant to safety and security issues

Membership

2.1 Membership is made up of 3 males and 3 females, four of whom shall be from the administrative areas, and two lecturers.

2.2 The Chairperson shall possess a legal background

2.3 The Director of Staff and Student Affairs shall be the Executive Officer, and shall sit within the Committee

2.4 The Deputy Pro Vice Chancellor shall be an ex-officio member of the Committee

2.5 The Panel shall be appointed by the Pro Vice Chancellor for a period of two years:
